Should illegal aliens receive in-state tuition?

Asked whether the state can continue to grant in-state tuition to undocumented immigrants, Texas Attorney General Greg Abbott said in an opinion Friday that theres not enough legal precedent to answer the question with certainty.

Abbott said the sections of the Texas Education Code that permit illegal immigrants to pay resident tuition at state colleges and universities could conflict with federal law. But he added, "Given the paucity of judicial precedent, we cannot predict with certainty that a court would so find."
The opinion comes 10 months after a state representative pointed out that a California court found that state had violated federal laws by allowing undocumented immigrants to receive in-state tuition.

Under the Illegal Immigration Reform and Immigrant Responsibility Act, passed in 1996, states cannot grant a "post-secondary education benefit" to someone who is not lawfully present in the U.S. unless they provide the same benefit to residents of other states.

A California appellate court has ruled that the federal law pre-empts California law, meaning California would have to abandon the tuition practice, which is similar to that in Texas. The case is now before the California Supreme Court.

The Supreme Court of California said ruled today 7-0 that an illegal alien or illegal immigrant can be a lawyer in California.

So why should any current California lawyer face being disbarred for a criminal act?


Since the illegal alien committed a Felony just by coming to America and is being allowed to practice law why shouldnt every lawyer in California who commits a crime get at least 1 free criminal act?

Theres one villain that has slipped notice: how illegal immigration, crime-enabling banks and open-borders Bush policies fueled the mortgage crisis. Its no coincidence that the areas hardest hit by the foreclosure wave - Loudoun County, Va., Californias Inland Empire, Stockton and San Joaquin Valley, and Las Vegas and Phoenix - also happen to be some of the nations largest illegal alien sanctuaries. Half of the mortgages to Hispanics are subprime. A quarter of all those subprime loans are in default and foreclosure.
Regional reports across the country have decried the subprime meltdowns impact on illegal-immigrant "victims." A July report showed that in seven of the 10 metro areas with the highest foreclosure rates, Hispanics were at least one-third of the population; in two of those areas - Merced and Salinas-Monterey, Calif. - Hispanics comprised half the population. The National Council of La Raza and its Development Fund have received millions in federal funds to "counsel" their constituents on obtaining mortgages with little to no money down; the group almost succeeded in attaching a $10 million earmark for itself in one of the housing bills passed this spring.
The Washington Post noted in 2005: "Hispanics, the nations fastest-growing major ethnic or racial group, have been courted aggressively by real-estate agents, mortgage brokers and programs for first-time buyers that offer help with closing costs. Ads proclaim: "Sin verificacion de ingresos! Sin verificacion de documento!" - which loosely translates as, Income tax forms are not required, nor are immigration papers. "
Fraudsters also have engaged in house-flipping rings using illegal aliens as straw buyers. Among many examples the FBI cites: a conspiracy in Las Vegas involving a former Nevada First Residential Mortgage Company branch manager who directed loan officers and processors in the origination of 233 fraudulent Federal Housing Authority loans valued at over $25 million. The defrauders made and submitted false employment and income documentation for borrowers; most were illegal immigrants from Mexico. To date, the FBI reported, "Fifty-eight loans with a total value of $6.2 million have gone into default, with a loss to the Housing and Urban Development Department of over $1.9 million."
Thanks to lax Bush administration policies allowing illegal aliens to use "matricula consular cards" and taxpayer-identification numbers to open bank accounts, mortgage fraud has grown. Money-lenders still have no access to a verification system to check Social Security numbers before approving loans.
In an interview about rampant illegal-alien home-loan fraud, a spokeswoman for the US General Accounting Office told me five years ago: "Considering the size of Los Angeles, New York, Chicago, Houston and other large cities throughout the United States known to be inundated with illegal aliens, I dont think the federal government is willing to expose this problem for financial reasons as well as for fear of political repercussions."

While offering credit cards to people who are here illegally and lack Social Security numbers, Bank of America has been offering checking accounts and even mortgages to illegal aliens for years. Lending giants Wells Fargo and Citibank are among those who have also extended home loans to illegal aliens.
In 2005, President of Immigration Matters Marti Dinerstein, angry over this practice, told CNN: “It’s institutionalizing illegality. Now there’s no distinction being made between the people that follow all the rules and those who break our laws by entering the country or overstaying their visas.”
An American cannot obtain a mortgage loan for a home unless he or she has government issued identification, established credit, and verifiable income. However, for several years, the banks have been giving mortgages to illegal aliens who lack all of these things.

Should A 35 year old Illegal alien in Fla. be granted a license to practice law in America courts?

A Florida mans bid to become the first illegal immigrant to obtain a law license in the United States met skepticism Tuesday from most of the states Supreme Court justices.


Jose Godinez-Samperio came to the U.S. with his parents on visitors visas when he was 9 years old, but the family never returned to Mexico. He graduated from New College in Florida, earned a law degree from Florida State University and passed the state bar exam last year.


"Hes somebody who has done everything hes supposed to do. He complied with every rule," Godinez-Samperios attorney and former American Bar Association president Talbot "Sandy" DAlemberte, said after the hearing.


Godinez-Samperios case is one of a few across the country. Illegal immigrants in New York and California also want to practice law there.


The Board of Bar Examiners in Florida found no reason to deny the 25-year-old Godinez-Samperio a license but asked the states high court for guidance, said the boards lawyer, Robert Blythe.


"Its not really about this applicant," Blythe said. "Its a broader question."


Justice Barbara Pariente compared Godinez-Samperios status to someone who doesnt pay federal income tax.

Ariz. Saves Millions Cutting Illegal Immigrant Perks

A U.S. border state that stopped giving illegal immigrants discounted public college tuition a few years ago reports saving millions of dollars after terminating the program that essentially subsidized illegal behavior with public money.

Fed up with the toll that illegal aliens were having on its state, Arizona voters overwhelmingly passed a law in late 2006 to deny them heavily discounted resident college tuition and other state-funded benefits draining the budget. Approved by more than 70% of voters, the measure also requires state agencies to verify the immigration status of applicants for public services such as child care and adult education as well as financial aide for college students.

Regardless, thousands of illegal aliens continue to annually apply for the costly perks which used to cost taxpayers tens of millions of dollars each year. Since the law passed more than 3,400 community college students and nearly 300 university students paid the much higher nonresident tuition because they couldnt prove they were in the country legally.

This represented a savings of nearly $8 million for one of the state’s community college districts (Maricopa County Community College District) alone. Combined with Arizona’s other junior college districts and its three public universities the savings are estimated to be in the tens of millions of dollars.

Arizona’s State Treasurer says the money is being appropriately used for programs that benefit legal residents rather than to subsidize the education of those who live in the state illegally. A handful of other states—including Texas, California, Utah, Maryland and Wisconsin—offer illegal immigrants discounted tuition at public colleges.

Earlier this month, Texas Attorney General Greg Abbott ruled that allowing illegal immigrants to pay in-state tuition breaks federal law though the state annually grants the coveted benefit to thousands of undocumented students. The opinion was a no brainer considering that a 1996 immigration reform law forbids states from giving illegal aliens in-state tuition unless it provides the same for all students regardless of residency.

It was that law that led a group of out-of-state students to successfully challenge the practice in California. SACRAMENTO, Dec. 12 (UPI) -- Dozens of U.S. citizens allege in a lawsuit that offering in-state college tuition to illegal immigrants is unfair to official citizens.

The citizens ask in Martinez vs. Regents of the University of California that undocumented students stop receiving tuition breaks in the California school system, while documented students receive compensation for past out-of-state tuition payments, Stateline.org said Friday.

A California Court of Appeals panel ruled in September that the immigration tuition practice was in violation of federal law, giving the lawsuit a green light.

Utah Attorney General Mark Shurtleff, whose state also offers illegal immigrants discounted tuition, has asked the California Supreme Court to review that ruling.

"Though not legally binding on other states, its (the appeals court decisions) singular presence in the judicial landscape casts a pall over the viability of his public policy, not only in California, but nationwide," Shurtleff said in a letter to the higher court.

Stateline.org said the other U.S. states that use a similar immigration tuition system are Illinois, Kansas, Nebraska, New Mexico, New York, Oklahoma, Texas and Washington.
