The Supreme Court on Tuesday gutted a key part of the landmark Voting Rights Act, passed in 1965 to end a century of attempts by former slaveholding states to block blacks from voting.

In a 5-4 ruling with the courts conservatives in the majority, the justices ruled that Congress had used obsolete reasoning in continuing to force nine states, mainly in the South, to get federal approval for voting rule changes affecting blacks and other minorities.

The court ruled in favor of officials from Shelby County, Alabama, by declaring invalid a section of the law that set a formula that determines which states need federal approval to change voting laws.

President Barack Obama quickly called on Congress to pass a new law to ensure equal access to voting polls for all.

When he was in his late 20s, John Roberts was a foot soldier in the Reagan administrations crusade against the Voting Rights Act. Now, as chief justice of the Supreme Court, he will help determine whether a key part of the law survives a constitutional challenge.

Memos that Roberts wrote as a lawyer in President Reagans Justice Department during the 1980s show that he was deeply involved in efforts to curtail the effectiveness of the Voting Rights Act, the hard-won landmark 1965 law that is intended to ensure all Americans can vote. Roberts anti-VRA efforts during the 1980s ultimately failed. But on Wednesday, when the Supreme Court hears oral arguments in Shelby County v. Holder, hell get another chance to gut the law. Roberts history suggests a crucial part of the VRA may not survive the rematch.

Section 5 of the Voting Rights Act forces certain jurisdictions with a history of racial discrimination to have changes to their voting procedures precleared by either the Justice Department or a panel of three federal judges in Washington, D.C. Section 2 of the law, on the other hand, applies nationwide, but it puts the burden on the plaintiffs to prove changes to voting laws or procedures are discriminatory. In effect, it makes it tougher and more expensive to challenge changes to voting laws and procedures.

During oral arguments in the case of Shelby v. Holder, Kennedy indicated he thought Section 5 was outdated and that Section 2 was an adequate substitute.
